OFFICIAL RULES
  1. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A purchase will not improve your chances of winning.
  2. INTRODUCTION: SAIL Magazine (a publication of Source Interlink Media) (“Sponsor”) is offering SAIL’s eNewsletter Sign Up Sweepstakes 2007- 2008, Sponsored by Standard Horizon (the “Sweepstakes”).
  3. ELIGIBILITY: The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who as of October 1, 2007 are eighteen (18) years of age or older. Employees of the Sponsor or Prize Supplier (as defined below) and their respective parents, subsidiaries, affiliated companies, dealers and agents, the foregoing employees’ household or immediate family members (defined as parent, spouse, child, sibling or grandparent) and employees of SAIL Magazine are NOT eligible to enter the Sweepstakes.
  4. TIMING: Sweepstakes begins on October 1, 2007 @ 3:00 PM USA Eastern Time and ends on March 31, 2008 at 3:00 PM USA Eastern Time (The “Sweepstakes Period”).
  5. HOW TO ENTER: To enter, go to www.sailmagazine.com and sign up to receive SAIL’s eNewsletter titled Under Sail. Please note that all required information/fields on sign up form must be fully and accurately completed or entry may be voided. Only one entry allowed from any person or email address. Five (5) winners will be chosen at random, one each month for five months starting November 2007 through March 2008. Winners names may be reported in an issue of SAIL during or after the Sweepstakes period. Sponsor reserves the right to include a Sweepstakes official sign up form/entry form at any additional authorized website or other authorized location.
  6. PRIZE: Five (5) prizes will be awarded, one each month for a five (5) month period, consisting of Standard Horizon handheld submersible VHF Radio, Model HX270S and other component parts including a drop-in charger base, 12VDC & 110VAC trickle chargers, 1400 mAh NiHd & AA Battery tray and a quick draw belt clip. Prizes are non-transferable and must be accepted as awarded. Subject to the conditions herein, prizes will be awarded. The win- ners of a prize are solely responsible for: a) any and all applicable federal, state and local taxes (including where applicable sales tax) due for said prize; and b) any and all applicable fees and expenses related to the acceptance, award, and use of said prize. Approximate Retail Value of each prize is $100. Total Approximate Retail Value of All Prizes: $500:
  7. RANDOM DRAWING: On or about November 30, 2007, and the 31st of each of the following four months (December 2007 through March 2008) a winner will be selected by random drawing from all eligible entries received via the online eNewsletter sign up form from previous month. The above- mentioned random drawing will be conducted by SAIL Magazine, whose decisions on all matters related to the Sweepstakes shall be final and binding. A participant selected as a potential winner must comply with all terms and conditions set forth in these official rules, and winning is contingent upon fulfilling all such requirements. Odds of winning depend on the total number of entries received that are eligible for each random drawing, entries do not roll over into next the month.
  8. NOTIFICATION: Potential winner will be notified (the “Notification”) by email (the only method of contact collected on the sign-up form) within about ten (10) days after the above-mentioned random drawing. Upon receipt of email Notification by a potential winner, an email reply from such potential winner that includes a full mailing address must be received by the sender of the initial email within ten days and thereafter. Then such potential winner will be sent the Affidavit Waiver Release and Indemnity Agreement (Affidavit), including where lawful a Publicity Release (prior to Return, to be correctly completed and executed by a potential winner in the presence of a notary public). This Affidavit must be returned to SAIL Magazine, Attn: Marketing Department, 98 N. Washington Street, Boston, MA 02114 within 20 days of its receipt. Please note that additional documents may be required at the discretion of Sponsor. Failure to comply with the requirements of this paragraph (or the return of any prize or prize notification as non-deliverable) may result in disqualification and in the forfeiture of any right to a prize, in which case such prize will be awarded to an alternate by random drawing.
  9. E-MAIL ADDRESS: In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the person whose name is on the entry form.
  10. RELEASE: By participating in the Sweepstakes and/or accepting a prize, a participant/winner agrees to defend, release and hold harmless the Sponsor and their respective parents, subsidiaries, affiliates, divisions, members, managers, advertising and promotion agencies, and the foregoing companies’ officers, directors, shareholders, employees, representatives and agents (collectively the “Releasees”) from and against any actions, claims and/or liability for injury, loss or damage of any kind (including any for the violation or infringement of any proprietary or personal right of any individual or entity) resulting in whole or in part, directly or indirectly, from participation in the Sweepstakes, and/or the use, acceptance, or possession of a Sweepstakes prize, and/or participation in a Sweepstakes prize-related activity. By participating in the Sweepstakes and/or accepting a prize, a partici pant/winner consents to and gives the Sponsor the right to use a participant’s/winner’s name, address and entry form information, to photograph/video a winner and a winner’s property, and in perpetuity to use a winner’s statements, quotes, picture, portrait, likeness, voice, video, biographical informa tion, prize information, and winner-submitted photograph(s)/video/text (in whole or in part, as may be adapted, edited or modified, as solely deter mined by Sponsor) for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, and on the World Wide Web, without review, notification or approval, all without limitation or additional consideration, unless prohibited by law. Entries will not be acknowledged or returned.
  11. CONDITIONS: Participants agree that by participating in the Sweepstakes they release the Releasees from any liability in connection with: a) Entries that are ineligible as a result of being lost, late, illegible, damaged, incomplete, stolen or misdirected; b) Any typographical or other human or technical errors in the offer or administration of the Sweepstakes, including but not limited to errors in advertising, these official rules, the selection and announcement of a winner(s), or the distribution/awarding of a prize(s); c) Any omission, interruption, deletion, defect, delay, misdirection, damage, line failure, injury, technical malfunctions or traffic congestion on the Internet/telephone network, or at any website, or any combination thereof. Sponsor reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes. In the event that the Sweepstakes is infected by a computer virus/worm, or is not capable of running or being executed as planned (as a result of but not limited to an error, omission, defect, delay, misdirection, tampering, unauthorized intervention, fraud, action of entrants, or technical failure) or any other cause which in the sole opinion of Sponsor corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right in their sole discretion to disqualify any suspect entry or entrant and to cancel, terminate, modify or suspend the Sweepstakes. In the event of such cancellation, termination, modification or suspension, notice thereof will be posted at the entry website men tioned above, and the winner(s) will be determined solely by Sponsor or an independent judging organization in a random drawing from among all eligible non-suspect and/or non-disqualified entries. In such event, Releasees shall have no liability to any participant who is disqualified due to such an action. Failure to enforce any term of these official rules shall not constitute a waiver of that provision.
  12. LAWS: Subject to all federal, state and local laws and regulations. Void where prohibited or restricted.
